Terms of Service

FinOps Beacon is operated by Bryan Wrinkle, an individual based in Fentress County, Tennessee, United States ("FinOps Beacon," "we," "us," or "our"). These terms form an agreement between you and Bryan Wrinkle and govern access to FinOps Beacon. By creating or using an account, you agree to them on behalf of yourself and, if applicable, the organization that authorized your use. If you do not agree, do not use the service.

The service

FinOps Beacon connects to Microsoft Azure through delegated Microsoft consent or customer-provided application credentials and performs read-only inventory, cost, metric, and recommendation analysis. Recommendations, forecasts, and savings estimates are informational and can be incomplete, delayed, or affected by upstream data. You remain responsible for validating and carrying out every Azure change.

Accounts and administrators

You must provide accurate information, protect account credentials, use the service only when legally able to enter this agreement, and promptly remove access that is no longer authorized. Organization administrators can invite users, change roles, configure integrations, export data, and permanently delete the organization. You are responsible for actions taken through accounts you authorize.

Azure authorization

You must have authority to connect every Azure tenant and subscription. Delegated access follows the connected Microsoft user's current Azure permissions and may stop working if that user loses access or the grant is revoked. Manual credentials remain controlled by your organization. FinOps Beacon does not grant Azure roles or promise that Microsoft will approve a requested connection.

Acceptable use

You may not misuse the service; bypass access, rate, or security controls; probe or disrupt systems without written permission; access another tenant; submit unlawful or malicious material; resell access without authorization; reverse engineer protected components except where law permits; or use the service to infringe another person's rights.

Ownership and feedback

You retain rights in the data you provide and authorize us to process it only as needed to operate, secure, support, and improve the service. FinOps Beacon and its software, presentation, documentation, and branding remain the property of the service operator and its licensors. If you provide feedback, you permit us to use it without restriction or compensation, without identifying you publicly.

Subscriptions, cancellation, and refunds

Plan features, prices, billing intervals, taxes, and included limits are those displayed when an order is placed. Stripe processes payment and hosts checkout and subscription-management pages. Paid plans renew automatically each month until canceled. You may cancel a paid subscription through the available billing controls or by contacting support@finopsbeacon.com. Cancellation stops the next renewal and access continues through the paid period unless the order says otherwise. Except where law requires or a written order says otherwise, charges already paid are non-refundable. Duplicate or erroneous charges should be reported within 30 days for review.

Availability, suspension, and changes

We work to keep the service available but do not guarantee uninterrupted or error-free operation. Features may change to improve security, reliability, or legal compliance. We may suspend access to address misuse, security risk, nonpayment, legal requirements, or a threat to other users. Where practical, we will provide notice and an opportunity to resolve the issue.

Confidentiality and customer data

We use customer data only as described in these terms and the Privacy Policy. Each party will use reasonable care to protect non-public information received from the other and will use it only for the service relationship, except when disclosure is authorized or legally required. The Data Retention Policy describes operational retention and deletion.

Third-party services

The service depends on Microsoft Azure, Cloudflare, Supabase, Stripe, and email infrastructure that we do not control. Their outages, API changes, account restrictions, and terms can affect FinOps Beacon. Your use of Microsoft and Azure remains governed by your agreements with Microsoft, and payment processing is also subject to Stripe's applicable terms and privacy notice.

Disclaimers and liability

To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. To the maximum extent permitted by law, FinOps Beacon is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Total liability for claims relating to the service is limited to amounts paid for the service during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.

Termination

You may stop using the service and an administrator may delete the organization at any time. We may terminate access for a material breach, legal requirement, or continuing security risk. Provisions that by their nature should survive termination—including payment, ownership, confidentiality, warranty disclaimers, and liability limits—continue to apply.

Governing law and disputes

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Before filing a claim, you and FinOps Beacon agree to try in good faith to resolve the dispute by written notice sent to support@finopsbeacon.com. Unless applicable law requires otherwise, legal proceedings must be brought in a state court located in Fentress County, Tennessee, or a federal court with jurisdiction over Fentress County, Tennessee. Nothing in these terms prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

Material changes will be posted with a new effective date and, when practical, communicated through the service or by email. Continued use after the updated terms take effect constitutes acceptance to the extent permitted by law.
